Thank you for your interest in becoming a test user for our elysium® products. We are constantly improving our products in order to make them even more accessible for users.

By completing this form you confirm your interest in helping us to improve our products through your expertise and give us permission to contact you in case we need you as a test user. As a tester, you will be a member of our Expert Panel. We will regularly access our Panel to test new elysium® products and features.

You are not obliged to accept requests at any given time. Participation is always optional, and you can remove yourself from the panel at any time by choosing to unsubscribe at the bottom of any study-invitation email you receive.

Terms of use

Welcome to elysium/BMS Audio’s Terms and Conditions (‘terms’). We appreciate your interest in our company, elysium/BMS Audio GmbH, Roßfelder Straße 65/5, 74564 Crailsheim, Germany, (hereinafter ‘elysium/BMS’) and its products and services. We offer test users (‘test users’) the opportunity to participate in user research studies (‘studies’) conducted by elysium/BMS.

Please read these terms carefully before submitting this form. By submitting this form, you accept these terms.

elysium/BMS changes these T&Cs from time to time. elysium/BMS informs test users about such changes via email. The change shall be deemed approved as soon as the test user agrees to this declaration and does not immediately terminate after receiving the information or agrees to participate in a study.

1. Registration as a test user

Anyone who would like to be selected as a test user must first register through this form. To register, test users must be at least 18 years of age.

After registering, test users will be entered in the elysium/BMS “Expert Panel” database (‘Expert Panel’).

Registration as a test user is free and voluntary. Test users can request the deletion of their data from the database at any time at no charge.

2. Participation in studies

2.1 Types of studies

elysium/BMS recruits test users for the following types of studies:

‘Field studies’ take place at a prior determined time and location in person.
‘Unmoderated online studies’ are conducted online at a time determined by the test user (within a certain period of time).
‘Moderated online studies’ are conducted online at a time determined by the test user and elysium/BMS.
‘Surveys’ are conducted online at a time determined by the test user (within a certain period of time).

2.2 Selection of study participants

elysium/BMS will select participants for studies based on test user’s information in the Expert Panel, additionally requested data and the required characteristics of participants needed for a specific study.

If test users are considered for a particular study, elysium/BMS will contact them directly and invite them to participate in the study. Participants for studies will be selected at elysium/BMS’s sole discretion and test users have no claim to participate in any particular study.

2.3 Confirmation of participation

After being contacted by elysium/BMS as potential participants for a specific study, test users can confirm their participation in the study within a certain time period communicated to the test user.

If a test user agrees to participate in a study but fails to do so, elysium/BMS reserves the right to block the test user from participation in further studies.

2.4 Remuneration

The type of remuneration depends on the study and will be communicated in advance by elysium/BMS upon consent to participate in the respective study. After successful participation in the study, the incentive will be automatically transferred to the test user. The type of remuneration can vary depending on the country of residence.

3. Responsibility and liability for studies

elysium/BMS does not exclude or limit in any way its liability to you where it would not be permitted by law. This includes liability for personal injury or death by negligence of elysium/BMS or its employees, agents or subcontractors as well as for fraud or fraudulent misrepresentation.

Other than that, elysium/BMS or its employees, agents or subcontractors will not be liable to you in any way, in particular for any damages or losses in connection with your participation or inability to participate in a study.

4. Validity of terms of use

If any provision of these terms (in whole or part) is held to be illegal, invalid or otherwise unenforceable, it shall be replaced by a valid provision with a similar meaning. The other provisions will remain mutatis mutandis in full force and effect.

5. Jurisdiction

In the absence of any mandatory legal provision to the contrary, these terms are governed by German law and the test user agrees to the exclusive jurisdiction of the courts of the city of Crailsheim, Germany.

Privacy policy

We appreciate your interest in our company, elysium/BMS Audio GmbH, Roßfelder Straße 65/5, 74564 Crailsheim, Germany, (hereinafter ‘elysium/BMS’) and its products and services. We offer test users (‘test users’) the opportunity to participate in user research studies (‘studies’) conducted by elysium/BMS.

We know that your personal data is important and we are committed to protecting it. This privacy policy (the ‘Privacy Policy’) aims to explain to you which personal data we collect about you, for which purposes/on what legal bases, and how we process it, including who we share it with.

We collect personal data about you in the following instances:

When you are shortlisted for a study
When you submit this form for recruitment purposes
When you are selected to participate in a study

Below you will find an overview of the personal data collected in each occasion, the applicable legal bases, and details on the data recipients.

1. Collection of personal data when you are shortlisted for a study

If elysium/BMS needs additional personal data that is not yet saved in the elysium/BMS Expert Panel for a specific product study, elysium/BMS will request the missing information from the test user by means of an email. A response to the screening questions by the test user is voluntary.

Note that the selection of test users for a study depends on whether the individual test user has provided a response to a particular question. This results in an increase in the likelihood of being selected as a test user for a study.

Legal basis: The legal basis for processing is your intent to take part in a study.

Purpose of processing: The processing of personal data is necessary in order for us to select you for a study. You can opt out from our Expert Panel at any time.

Storage: The personal data you submit is collected and stored for internal use by elysium/BMS and for our own purposes. Please see Section 4 for a list of the storage and processing tools we use.

2. Collection of personal data when you are selected to participate in a study

If you are selected to participate in a study, we will send you a short reminder with the details.

Legal basis: The legal basis for processing is your intent to take part in a study.

Purpose of processing: The processing of personal data is necessary so that we can contact you, and to provide you with information, such as answering questions, updates on our products and services, and marketing information. You can opt out from our Expert Panel at any time.

Storage: The personal data you submit is collected and stored for internal use by elysium/BMS and for our own purposes. Please see Section 4 for a list of the storage and processing tools we use.

3. Collection of personal data when you submit this form for recruitment purposes

Purpose of processing: The processing of personal data is necessary in order for us to add you as a test user, as well as selecting and contacting you for a study. You can opt out from our Expert Panel at any time.

Storage: The personal data you submit is collected and stored for internal use by elysium/BMS and for our own purposes. Please see Section 4 for a list of the storage and processing tools we use.

4. Recipients or categories of recipients / third country transfer

Your personal data is or may be transferred to the following recipients or categories of recipients by elysium/BMS:

Employees and management of BMS Audio GmbH
Employees and management of elysium audio solutions GmbH

The following services and software are used for processing: Google Workspace, Dovetail, User Interviews Research Hub, DocuSign, Notion, Maze, Sprig

5. Storing your data

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice will require us keeping your personal information for longer than the period of time in which testers are part of the Expert Panel. When you unsubscribe from the Expert Panel your personal data is removed automatically.

6. Your data protection rights

You have certain rights on the basis of the applicable data protection law. We will respond to your request without undue delay, at the latest within one calendar month after receipt. Please note that we may ask you to verify your identity before responding to such requests.

Within the framework of the legal requirements, you are generally entitled to a claim against elysium/BMS:

confirmation as to whether personal data concerning you are being processed by elysium/BMS
correction, insofar as this data is incorrect,
information about these data and the circumstances of the processing,
restriction of processing in specific cases determined by law; and
deletion, insofar as there is no justification for the processing and no (longer) obligation to retain,
transfer of your personal data - insofar as you have provided it - to you or a third party in a structured, common and machine-readable format.

In addition, you have the right to revoke your consent at any time with the consequence that the processing of your personal data, in accordance with your declaration of revocation, becomes inadmissible for the future. However, this does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.

Finally, we would like to inform you of your right of appeal to the German supervisory authority "Landesbeauftragte für den Datenschutz und die Informationsfreiheit Baden-Württemberg".
