Workday Research Panel Terms and Workday Privacy Statement

Please read these Terms carefully as they govern your participation in the Workday Research Panel.

1. Representations and Warranties. Panel Participant (hereinafter “Participant” or “You”) represents, warrants, and agrees that: (i) You are at least 18 years of age; (ii) You understand that adding Your information to the Research Panel or participating in any Study is completely voluntary; (iii) You will comply with these Terms and all applicable laws; (iv) by providing Registration Information, and/or participating in the Research Panel or in any Studies, You will not violate any agreement between You and any third party; (v) You will only provide Registration Information about Yourself; (vi) in Your participation on the Research Panel and in any Study, You are acting solely in an individual capacity, and not as an employee or agent of, or at the direction of, any organization; and (vii) You will only answer questions in Studies specific to Yourself and not about any other individual or third party.

2. Registration. By responding to the questions above and clicking ‘Submit,’ You are registering to be part of Workday’s Research Panel. Workday will include and maintain Your name and other information You provide in this form (collectively “Registration Information”) for Workday to contact You for potential participation in future Workday-conducted research studies (“Study” or “Studies”). The purpose of the Research Panel is to evaluate and match participants for Studies. By signing up for our Research Panel, You may be contacted to participate in a range of different Study types, such as remote interviews, surveys, and prototype interactions. You may decline to participate in any such Study at Your discretion. You may request that Workday remove Your contact information from the Research Panel (“Unsubscribe”) at any time by emailing uxresearch@workday.com and requesting to be unsubscribed from the Research Panel.

3. Incentives and Gifts. You understand that Registration for the Research Panel, and participation in any Study is completely voluntary. Workday is not providing a financial incentive, reimbursement, or valuable consideration for Your registration, or participation on the Research Panel. Workday may provide You with a token of appreciation, OF NOMINAL VALUE, at its discretion. It is Your responsibility to decline such a gift and notify Workday if You cannot receive any such gift or token of appreciation for any reason including due to applicable law, employer policies, or other third party restrictions. If You are employed by the U.S. federal government, or in any capacity prohibited from accepting gifts due to Your employment or relationship with the U.S. government or any other governmental agency or body, You must not accept any gifts or tokens of appreciation and must notify Workday of Your status as a U.S. Federal employee or equivalent/similar employment or relationship status.

4. Warranties and Disclaimers. This website, registration, Research Panel, Studies, or anything provided to You pursuant to Section 3 ARE PROVIDED "AS IS" WITH NO WARRANTIES OR GUARANTEES WHATSOEVER. OTHER THAN AS STATED HEREIN, WORKDAY MAKES NO GUARANTEE THAT THIS WEBSITE WILL OPERATE AS INTENDED, THAT YOU WILL BE CHOSEN TO PARTICIPATE A STUDY, OR THAT YOU WILL RECEIVE ANY GIFTS FOR YOUR RESEARCH PANEL REGISTRATION OR STUDY PARTICIPATION.

5. Intellectual Property. You hereby irrevocably grant and assign to Workday all ownership and intellectual property rights in and to all Feedback (defined below) that You may provide as a part of the Research Panel or participation in any Study. Workday has no obligation to use Feedback. You agree to execute any assignment of rights that may be required for Workday to establish, perfect, or protect any rights in Feedback. Should You fail to do so, Workday is hereby granted an irrevocable right and “power coupled with an interest” to act as Your attorney-in-fact to execute such documents. “Feedback” means Your responses, suggestions, recommendations, ideas, or other feedback provided in any form as a part of the Research Panel or participation in any Study.

6. Data Privacy. Workday will collect from You contact, demographic and employment information as well as information about Your use of Workday products and services, including whether assistive technology is required. Data elements collected may include, but are not limited to, name, email, country, age, employment status, industry, company affiliation and size, manager or independent contributor status, usage of Workday, education level, technical aptitude. You agree to provide and maintain accurate and up-to-date information about Yourself during Registration and any subsequent Study. Information provided will be used to identify suitable Studies for You and to invite You to those Studies. You agree that Workday may analyze Your usage data of the Workday platform, if You are currently an end-user, to inform our selection of You for suitable research studies and to inform our study results. Your information will be handled in accordance with the Workday Privacy Statement. You can exercise Your privacy rights as directed in the Workday Privacy Statement. For information on the cookies used in this site, please review the User Interviews Cookie Notice information. Your Registration Information will be retained for up to twenty four (24) months after the last interaction with You. If You unsubscribe from participation in the Research Panel, we will retain minimal contact details (i.e., name, email, and phone) in a restricted system for the purpose of not inadvertently re-adding You to our Research Panel via third parties’ lists.

7. Updates. Workday may update or terminate these Terms at any time in its sole discretion and without prior notice. It is Your responsibility to check these terms and the Last Updated date regularly at https://community.workday.com/node/1095371?check_logged_in=1.

8. Termination. Either party may terminate these Terms at any time. You may terminate these Terms by sending an email to uxresearch@workday.com and requesting to be Unsubscribed from the Research Panel. Workday may terminate these Terms by removing Your Registration Information from the Research Panel.

9. Indemnity. You agree to indemnify and hold Workday harmless from any and all loss, liability, claim, demand, or damages incurred or arising out of Your violation of these Terms. You may not settle any third party claim on behalf of Workday without Workday’s prior written consent.

10. Limitation of Liability. NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, EVEN IF SUCH PARTY KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY THEREOF.

11. Miscellaneous. These Terms govern Your registration for the Research Panel and constitute the entire legal agreement between You and Workday on this subject. All legal matters arising out of these Terms are governed by the laws of the State of California without regard to its conflict of laws provisions and You agree to submit to the jurisdiction of the courts of Alameda County, California. You acknowledge that Workday may apply for injunctive remedies in any jurisdiction.
